The following are various ways to express some one�s dissatisfaction/agony and draw some one else (Government/Media/Public) attention.
1. Daily Fasting : One or more people would sit for fasting from 6 AM to 6 PM. One group would pass on the fire to next group.
2. Continuous Fasting : One or more people would sit for fasting 24 hours a day. Such people should not have health issues like Blood Pressure, Gastric Trouble, Sugar, insulin deficiency, Heart relates issues. This may cuase arrest.
3. Protesting : Conduct a rally with group/mass of people with immigration ply cards and banners.
4. Wearing Black Ribbons : People would wear/put a small black ribbon on their shirt pockets (Upper left side of the chest) and attend duties. We can draw people attentions. Such ribbon should have white color immigration slogan printed on it.
5. Distributing Flyers : Distributing Flyers/Handouts to people in respective areas.
6. Banners : Display banner/show outs in the Traffic Island Medians
7. Flower Campaign : Sending Flowers to respective people, also called Gandhi giri.
8. Silent Sitting : Sitting in front of USCIS silently (no talk).
9. Silent sitting in front of Senators house: Group of people should sit (kind of protest) in front of respective state senators. We can draw maximum MEDIA attention.
10. Sweeping Roads : A group of people would sweep roads by wearing immigration slogans jackets.
11. Organize Blood Donate Drives : Interested member would donate blood (We should explain to media, why we are doing so).
12. Rally in All Major Cities : Conduct a rally in all Major cities (where we have at least 100 members) at the same time.
We still have various other ways to express our dissatisfaction, however, they are little rude and could cause more issues.

Thanks for the info. I went and pulled up the 9089 filing and just saw that the filing date was 15th may 2006, the expiry date was 3/31/2008 and hence i might have incorrectly assumed that the filing date was 2 years before that.

Below is a recent story on travel on AP. I see many posts where folks are asked at POE by CBP offcials if they are still working from the petitioning employer.
Can you advise why CBP officers are even asking to several AP travellers if they are still working for the GC petitioning employer?
My situation: I am not working for the petitioning employer anymore and dont have an attorney as well and so need to get prepared to answer the CBP officails why i am not working for the petitioning employer at POE and you know, CBP officails dont understand AC-21 etc

I feel like sharing mine as mine is the most horrifying.
After scanning my expired H-1 and reviewing my AP, I was sent to "secondary check" where they ask you few questions and verify the authenticity of the documents.
I was asked if I work for the original petitioner? I said no, currently I work for another employer. I showed them my H-1 approval (I-797). The CBP officer was about to stamp my AP and he was told by a "side-kick" that I have to be employed at the same employer otherwise what is the guarantee that I will go and work for that employer. I calmly explained the fact that GC is for future employment and per AC-21 I can change after 180 days. The CBP officer said wait here and then he walked in to some room. He returned after 20 minutes and I was told to go and wait and other officer will take care of the situation. From one officer to another and another to another. I was asked if I am trying to do any fraud. Finally after 5 hours of questioning, I somewhat lost my temper and told them that either send me back to home country or let me go. So after making few phone calls, they concluded that they don't have access to all my records on their system and it is very gray situation so the office in downtown will take care of the situation.
They took my passport, AP, H-1 approval letter and told me to go to downtown office after 30 days and they will decide what to do.
My lawyer was kind enough to accompany me as she was also upset with their act. When I went there, we were rudely asked completely out of place questions which had nothing to do with whose employer I work for or anything and I was told that "I" confused CBP officers by showing AP and H-1 and I should have just shown them AP and everything would have been fine. I am the culprit and I choose to get myself in trouble.....
I said nothing and just saw him stamping my AP and walked out. I don't know what to conclude out of it. But A friend of mine had valid H-1 and AP and they asked "has any one applied for AOS for you?" he said yes. They asked him to show 485 and AP if he had and same story,,,one officer to another and another to another which lasted for 3 hours and finally his H-1 was stamped.
So, again I am not sure what they are trying to get out of this but this is happening at the airport. I am not trying to scare anyone but just be prepared to deal with such situation and keep in mind that you are not doing any fraud and keep the honesty.
I don' think they should have been rude. However they do have a point. He should NOT have shown BOTH H1b visa and AP. You can enter on one or the other.

How are you sure that the "sneaking in" of our provisions with the 'undocument workers' provisions is going to alleviate our plight?.
Note that the staff to support this overhaul is not going to increase overnight. Consider this - 100 people (just a 'supposition' - this is not a hard number) are working on 500,000 applications today; With the passage of provisions for 'undocumented workers', the same staff of 100 is going to work on 11 million 500,000 applications, atleast for the next 1-2 years. Do you understand the mess that this will create? It will be a similar mess as the 'Labor backlog center', where the applications of 2003 are still waiting for their certifications.
Although I agree that we should work towards supporting the current provisions already in the bill, I still feel that issues such as 'I-485 application without PD current' and 'removal of hard country quota' are important, in order to ensure short-term reliefs. These provisions may not help your specific case, however it may help 1000s of other cases.
Just my opinion from the limited knowledge that I have of, how UCSIS operates!!!

I understand that you guys have done a lot with limited resources, but trying to isolate yourself from the issue of illegal immigrants issue is not going to help us either. We need to use the momentum of illegal issue to sneak in our provisions (which we already have with the advance degree provision, exception of spouses from cap,capture of unused visa numbers).
I think you are wrong in stating that I do not grasp the issue that AILA is only interested in illegal immigration issue and not in EB3 retrogression. I know that more than you can imagine, which is why I have been urging the forum to stop asking every one to fax the senators with requests to remove hard limits by country or even concurrent filing of I145 when visa numbers are not current. I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B’S.
Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator’s office we at least have some one who could explain the situation in a way that makes sense?
Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant’s issue. The reason for that is the issue that the U.S has is with ILLIGAL IMMIGRATION. The EB retrogression is really our problem, not some thing that is going to raise alarms in the senate. Which is why any amount of hue and cry is not going to change the situation? We should be glad that the advance degree provision, recapture of unused visa numbers and exemption of spouses from cap will make way for a few people and in the process clear up the backlog in EB3 category. We need to back this unanimously instead of trying to introduce new amendments in the last minute. No offence but

The issues, unlike those of illegals, are largely non-controversial, some as simple as asking USCIS to reduce our waiting time from 8+ years to a year.
Since we are all highly skilled in areas where there is a shortage of US available labor and provide a disproportionately large benefit to the US economy, we believe that approving our already filed applications on an expedited basis could be helpful to all of us.
Currently, a bill that is under consideration by Congress called the SKIL bill will solve almost all of these non-controversial issues.
I and my fellow members would much appreciate it if you could run a story on us, and/or direct us to a source that helps publicize our organization.

This Tracker facility we have in IV is good. Kudos to the Admin team who implemented this thing.
These are my observations. I could be grossly mistaken. Pardon me if I am wrong.
There are approximately 26,000 people who have put in their priority dates and other such data in the tracker. When I compared similar cases, I got some 265 who were EB3 India with a priority date in 2002. That is approximately 1 %, give or take.
Here I have ignored EB3 India 2001 guys. But that number would be very less I believe.
1% of 400k is 4000 which is what USCIS issues GC for EB3 India in a year.
Does that mean I could get my GC this year.
Hope these numbers are right.

We had around 17 highly charged up and dedicated IV members who definiitely want to do "something".
There was a diverse crowd this time. We had F1 students, who are now beginning to understand the gravity of this issue. One student is a student in Journalism and is currently doing project in legal immigration.
One physician came all the way from Connecticut and his wife another physician doing residency came all the way from Long Island and our dedicated leader mpadapa came all the way from Poughkeepsie.
Me and another family came from Queens. Some were from Manhattan.
Almost everyone else resided in New Jersey.
'laborchic' was the man behind this meet and greet and his enthu never went down, he always stood up and adressed the gathering. He stressed on the importance of Unity, which the community lacks.
mapdapa discussed about local law maker meetings. He has been managing and scheduling local lawmaker meetings. Almost everyone instantly offered to meet their lawmakers - but definitely with training and some direction and efficient management.
Me, mpadapa, singhsa3, siravi and laborchic were explaining to folks the importance of IV, our goals, plans etc...

In addition, logiclife's email newsletter got us a few more people and I do not have their IV handles, they are Badri, Tejesh, Alpesh, Sailesh.
One guy (Alpesh) was a part of San Jose rally and was an active member in the CA chapter and recently moved to NYC.
Maya is a beautiful place for a evening drink and a snack and discuss things - only drawback was that they played music that was loud, and we had to ask them to reduce the volume. The snacks were very good.

The meeting must be in a conference hall or a banquet hall and have parking facilities.
One or two core members must be present
Training for law maker meets must drive the entire session with other stuff also being discussed in between.
Educating people about IVs goals and the hard work IV does in the background is a must in every chapter meeting.
We all decided that we will be active from now on, if we were not active earlier. We will build a strong State chapter.
Those who were in the "meet and Greet" yesterday - please post your experience - we all took turns and spoke and shared ideas - do please post your experience and your views.
There was a diverse crowd this time. We had F1 students, who are now beginning to understand the gravity of this issue. One student is a student in Journalism and is currently doing project in legal immigration.
One physician came all the way from Connecticut and his wife another physician doing residency came all the way from Long Island and our dedicated leader mpadapa came all the way from Poughkeepsie.
Me and another family came from Queens. Some were from Manhattan.
Almost everyone else resided in New Jersey.
'laborchic' was the man behind this meet and greet and his enthu never went down, he always stood up and adressed the gathering. He stressed on the importance of Unity, which the community lacks.
mapdapa discussed about local law maker meetings. He has been managing and scheduling local lawmaker meetings. Almost everyone instantly offered to meet their lawmakers - but definitely with training and some direction and efficient management.

I am not sure how encouraging it will be for you to hear about some of our friends in tristate area.
Pretty much like you (Desi employers, 80/20 or 70/30 arrangements, found contracts through dice/monster/hotjobs, filed in jul 07 fiasco and AC21'ed off to full time positions). There is nothing wrong with these arrangements but unfortunately they are considered pretty much illegal from the H1b & immigration point of view.
Employers of many of them who have received their GC and many who are pending are currently being investigated. First they closed the gaping hole called substitution and now they are after all these sketchy employers and the petitions pending/approved through them.
It sucks for people whose petitions have been approved and are now trying to crystallize their lives by buying homes, etc. Administration holds the trump card in that they can revoke GC/citizenship anytime.
Few of these desi employers were nice enough to notify the beneficiaries. Many of these cases involve people who filed for EB2 i-140 to capture their EB3 dates after changing employers.

Yes but in Canada you will breathe clean air and drink clean water. You will have electricity 24 hrs a day and water 24 hrs a day. You wont find trash on the street and you wont be considered second class citizen if you arent SC/ST/OBC due to reservations. You woint have to give "donations" to get your kid admitted to Class 1. You wont face a system where a simple court case drags to 50 yrs or a case where doctor will not treat if before police does a "Panchnama" if you had an accident. You wont have to bribe everyone from minucipality to police to start a business.
I have driven in and around Toronto for a couple of hours and did not find it much better than driving in Trivandrum/Cochin.
Other points, I can only talk relating to the US and here we go.
"you will breathe clean air and drink clean water." - The air in the US is as polluted as that in India as attested by the rising level of Asthma and the repeated Code Red warnings during summer time. Almost same story for water. About a year back, the DC govt. even admitted that the water supplied by them contains too much bad stuff.
"You wont find trash on the street" - only when you live in a decent community. Just walk around half an hour around NorthEast DC and hope you will change your mind. Do not attempt to walk around the downtown of any US city after 6 PM. We don't want to loose any of the IV members.
"you wont be considered second class citizen if you arent SC/ST/OBC due to reservations." - Who is considered second class citizens is a subject unto itself. But if you are complaining about reservations, you have never heard of affirmative action.
"You woint have to give "donations" to get your kid admitted to Class 1." - Agreed public schools are free, just like they are free in India. If you want your kid to study in a private school, please pay $5000 per year.
"You wont face a system where a simple court case drags to 50 yrs" - I had prefer a case dragging for 50 years or more against a wrong court decision such as we saw during the 2000 US presidential election.
"a case where doctor will not treat if before police does a "Panchnama" if you had an accident" - I think the situation in India has now changed regarding hospitals refucing to treat people due to police case and such. Now, all hospitals (private hospitals included) are required to treat traffic accident victims asap.
I am not trying to say, India is paradise. We have lots of crap going around. Many things still stink, but so is the situation in many "great" countries.

We ( myself and my wife ) applied at Texas Service Center , Dallas Lockbox.
- Appiled on Jul 7th
- mine approved on Sep 10th
- wife's approval on Sep 16th
After like
50days - spoke to National service center ( No help )
56 days - wrote an email to the POBox printed on the receipt notice ,explaining about my situation that i have already purchased tickets and need to travel on Oct 8th . Consider this factor under financial loss and expedite, added 4 photos , 2 each., invoice from travel agent, and attached receipt notice copy. ( not sure if that helped ).
later that day - I booked infopass appointment
next day - I saw SLUD on my case.
Sep 10th - I got text ( from the USCIS online profile ) noting approval,
next day - called NSC and asked why my wife's case is not approved yet, they said they will process individually , and it takes upto 30days to receive the AP copy.
but after 3days i got the physical approval. For my disappointment they didnot processed my wife's case along with mine.( we sent together ).
Then we called NSC explaining,but this time i could tell mine was approved and her is still pending and explained to expedite based on financial loss. she accepted it and sent a notice to local office, but also alerted us its discretionary.
On Sep 16 we got approval text message for my wife too.
after 3 days we got the physical copy for my wife, also got the letter in a different envelop about the "Acceptance of expedite process " ( well it was no use, but thats how their systems are inlined ) :eek:
Out of curiosity we were tracking other AP receipt notices ( by altering last few numbers of ours and they showed same receipt dated ) online in case status window. it showed one applicants approval was done and the adjoining applicant was kept pending for few days. after we got my wife's text message, we searched again those other APs and surprisingly all those got approved as well.
My recommendation to others in hurry ,if they crossed 50days , try taking info pass , talk to NSC . just donot leave it at its pace.
