Dear All,
The idea behind this thread was to consider the option of a Time Bound Path for he beneift of the existing EB2 / EB3 folks who have filed Labour / I - 140 / 485.
I think the purpose of this thread is totally lost.
I am not sure how STEM or F1 or whatever should be a discussion here.
Anything we start here ends up in an acrimonious debate and many a time becomes very unpleasant and personal.
What are we all here for? Is it not our idea to to bring some relief to the EB immigrants?
Once again I request one and all to kindly refrain from unpleasant debates and think of working together for the welfare of the EB2 / EB3 community.
If we have our objectives clear and work towards a common goal, we sure can achieve success!
Kindly try to understand!!!

The idea is interesting, but I am not convinced. I am a skeptic. Becacuse the question is how will anyone be able to make this idea into reality. Someone should manage a timeplan, budget for this bill. We also need few people to go to Capitol and talk to media and Senators. We need someone to become a leader of this idea. Without a leader and timeplan I cannot buy this idea.
Questions to the person who started this thread:
1. Can you also post the draft of this bill or a document explaining this bill.

As an IO working in USLameIS, I absolutely cannot agree with your sentiments! In fact, that is the worst idea I have ever seen. Why, if we did that, we would give you applicants a sense of security. We can't have that. You would be released from your suffering and anxiety. That would render our cleverly thought out process to make-you-wait-forever meaningless.
On top of that, you add a layer of work to me! That cuts into my 3 hr lunch, 2 hr coffee time, and 1 hr toilet break. NO!
And the worst thing ever is: should the idea be implemented, it would add transparency to what we are doing and.. and.. oh noes! *GASP* we would have to provide accountability! NO NO NO NO NOOOOOOOooo.

Hi,
I am married and my husband is working in US on H1B visa. I came into the country with an L1 visa in Dec '06. The I 94 is valid till Oct 2009.
In Apr 2007, I applied for my H1B and it was approved with a start date of October 2007.
I quit my company by end of May 2007. Since the H1B was NOT applied with COS, I applied for my H4 last week but I have not got the approval notice for H4 yet. :(
Is it still possible for my husband to file my 485 along with his? What do I enter for questions regarding my current status?? Can I say that my current status is H4 and give the "valid till" date as the end date of my husband's H1B date?
Please help!!!

However, kindly note that immigrant friendly laws and economic (job) opportunities are different subjects.
People do not want to go to other countries because the job oppportunities are less. Not because the immigration rules are bad :)
People want to come to the USA because job opportunities are better, not because the immigration rules are friendly :)
Here in IV we are purely dicussing immigration. That is our main agenda.

Like in the movies Rang De Basanti .. newer generation was compared to Freedom Fighters and like in Lage Raho Munna Bhai -we had Non Violence portest Heroes, I am seeing very comparble Heroes in the Immigration Voice Core team. It does take lots of guts and courage to do the right thing , at such a high , sensitive level , with peacful, intelligent talks... especially in a land which is not yours for sure yet.

The bigger question here is .......Are there any IOs sitting at the fingerprinting place . If yes, are they authorized to give out such info or even entertain any such requests ??
That is incorrect for my local ASC. I know that for sure. When I went to ASC for FP I do not think they were capable of answering any case related questions. All they do there is take FP notice , stamp it and do FP. They ask you to goto local office for any questions related to your case.
Secondly how come the IO had the authority to show an internal memo to a customer. Does it make sense?

I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US & came back to my home town. Have been working here for 6 years now in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh masters graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

I think we should unite among ourselves rather than talking about all these circumstances. Yes I agree with Ganguteli... People got their labor subsituted because they had a oppurtunity and a provision that was legally correct. Instead of sitting and cribbing lets look in a direction which is going to unite all these streams into a big force.
Com'on guys, stop looking at things from a closed prespective. We need to be open and look at a grand agenda.

Your PD is not yet current.
If they have issued GC to you, it was a mistake and you should report it to USCIS to avoid future problems.
There were several discussions on this forum about this issue.
Report to USCIS ASAP that you have been approved by mistake.
I thought with PD of 2004 by now you should be well aware of how Visa bulletins work. :confused:
Either you went into hibernation after filing for your GC back in 2004 or you are just faking your profile.
If your PD was current, but they didn't give you a visa, that is a mistake. Why should someone report getting a visa is a mistake? He applied for the visa, he/she got it. Is it his/her job to watch USCIS? What future problems should he/she expect for getting a visa?
Further, it is great mis-impression that everyone who applies for a GC watches visa bulletins, or knows how they work. I for one, knew nothing about visa bulletins, or EB1,2,3 etc. until the Washington rally. When my LC was filed, I only knew that my GC has been filed, and it would take years. At that time, even until recently, I never even expected a GC would come before I would decide to go back. There is a higher percentage of those who don't watch VB than those who do. I know many in my circle, who are waiting for GC but never bother about VB. Some don't even have emails. Perhaps VB watching is more prominent among computer guys.

I have heard from the forums and also the attorney, that it is not unusual to call only the "derivative of the applicant"(spouse) for interview. But husband/wife may choose to accompany the spouse for the interview. Since I was there, I answered some of them too.
