my priority date is jan 2003.first ours was at TSC and then it was transferred to VSc and now it was transferred to TSC.
Take all the options available to you ( congressman, ombudsman, senator, calling USCIS and infopass appointment)
You may also ask your attorney to send a letter USCIS through AILA - liason office.

Chandu, my question is not whether HR dept can handle it properly or not.
My intention/question here is if an applicant is on H1 (most of the cases 5th or 6th yr of H1) and then loose the job and until he finds other job (has EAD but never used it) the applicant does not have payroll running during the break. then technically is he ok or does he has to maintain h1 status or does EAD protect him.
Coz until he finds a job and files for AC21 an applicant does not do any thing.
And what do you mean by satisfy AC21 criteria. unless you find a job you cannot file AC21....so during the gap (what is the status of this gap?...technically I am trying to find an answer. please point me to a link or document. If you are aware of it, else can IV find an answer to it)

As far as I know, if you filed for 485 and crossed 180 days after that with the same employer - it basically means that you have satisfied AC21 minimum requirement and you must look for a new job under same or similar category. If you manage to find a job pretty quick, then you can go for h1b transfer and it should not be an issue, but if it is taking time, then you may have issues with transfer because you may not have paystubs, but technically, you are legally allowed to stay because a decision on your 485 has not yet been made and before a decision is made look for a new job in same or similar criteria.

This is my first message after so long time...
USCIS stoped issuing interim EAD before years... We just been to local office this Monday and they said they don't issue it any more..

This has to be one of the best and most effective chance we have to make our point directly to the lawmakers
IV is looking for someone who is in the �limbo� stage, and has made a significant contribution to the economy (ie, invented something, made a medical discovery, created a lot of jobs, etc.)
Please treat this as very very urgent. We need someone like this ASAP.

for people that have their case are among 350000 case pending in PBEC the retrogression has no effect at all unless their case clear out before the retrogression get solved.
There are so many of us had been waiting for their labor get approved.
5, 6, 7 year are a long wait.

I think your company HR should get convinced for filing in EB2. The lawyer will hear what your company HR says. Yes its salary and designation that matters. I think a Senior with Masters and good salary can ask for filing in EB2. But if your HR by rule has decided that your position does not require Masters then you cannot file in EB2.
Most of the big companies have this rule. If you are with a small company and your access link to HR is not hard then you can convince them to consider for EB2.

If you were not told the correct bill rate, you can recover that money. Simply ask them in writing to show you the contract since you are on 70/30 basis. The written contracts, oral contracts, emails all stand in the court but how will you prove an oral contract? If you have found an offer that meets your expectations just quit. We all make the same mistakes. We spend our time on working out things where they are not working. Just "quietly" without your employer getting a hint, find a job and quit.

It is easy to get carried away saying that the employer is blood sucker etc. But very clearly, you should know that there can't be these kinds of contracts on H1. The employer knows that people who go to them are on thin ice, and so does the employee (employer is there to do business -- he is not running charity).
Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.
To top it, OP goes on an offensive when people point of the bitter truth to him. This site should not promote illegal behavior, anybody seeking advise on these topics should be severely castigated, because they broke the law too (and they know it, just dont want to admit it). Or maybe we should encourage these people to report to DoL so that all of them can be punished for misusing the laws.

not a single person has explicity voted "No". In reality though, everyone who has viewed this thread (1563 views when I last checked - even if you assume each person has checked this thread at least 10 times, that's about 156 individuals out of whom only about 35 have voted so far!) and not bothered to vote is essentially voting "No"! The above poll is a loaded poll favoring one option only. Is the only reason someone may not want ebill is that they dont care a damn about the trees. NOPE. It can be a lot of other reasons - they may feel not so good about internet security or may not be internet savvy. And of course, paper bills can be on recycled paper and whole lot of other arguments are not covered.
Similarly your poll is very much loaded.
And again, you havent defined "more". Currently, I believe the contribution limit is 25 dollars per month. When you say more - what number are you thinking of. And now look at the folks who said YES. What numbers are they looking at. If you had put in a number and said "are you willing to pay x dollars per month .." - then you can be assured of that the members who say YES are on the same page as you. Right now, what you have is a number of folks but they may not be on same page.
And what is the definition of "updates" ? We are not working here on a fixed time project where the deliverable is due at the end of period 'x'. For quite a lot of period, the updates will be generic and on the lines of "we are working on getting to our goals and we are making progress". You will not get any more details than this. Turn around and check with the folks who said YES -- is this what they are expecting. Or they are expecting something different.

I dont know the exact number but have a strong feeling that this number will probably in the 10-15 percentile only. And guests is not equal to an unregistered IV member. Not every person posts on this site. There are a lot of people who just browse the forums and dont post - they dont need to login everytime they come on to this site - therefore you will see a good chunk of visitors but they necessarily are not unregistered members.

None of what I wrote above is personally against you - I appreciate your efforts but feel that we need to approach it differently - probably equating updates with money is not a good approach given that once someone gives money , they may start having a feeling of entitlement and we may not be ready to handle it.
