Does it mean they would stop processing I140 premium applications which have already been sent. My I140 was pending for 6 months and I changed it for premium after the dates became current, it was sent by my lawyer this Monday (25th) and received by USCIS on 26th. Does this mean it will not be processed or does this mean they will not accept any premium processing applications from July 2nd.

Guess What from NOV - 08 to July 09, the VB will have older Cut off dates and after July 09 DOS will open the flood gate and move the cutoff of to 2007 or even 2008.

I am exactly doing the same thing that anandrajesh mentioned above. I have my tickets booked for Nov 21st and its already more than 60 days for me. I have called them to expedite it. will be faxing the documents and letter to local congressman and uscis ombudsman today. I am not even sure why we pay so much of money to these people and do all this to just do their work. But what can we do, we are at their mercy.

These are the people who were able to convince NIH to double its funding in 5 years time a couple of years back. These are the people who are now saying that there is no job and money for US-born, so first get more fundingand training for us citizens, before you get foreigners to carry out research ...
It is obvious that the issue is becoming more and more acrimonious, entangled with a lot of other issues - both political and economic. Unless the retrogressed are willing to take this to heart and put up an intense effort, in coming years the matter is going to get worse. Next few months could be the only ***healthy*** window of time to achieve a remedy for retrogression. Not only the economy is driving anti-highskillimmigration groups more vocal, we are slowly finding the pro-immigrant support base thinning out because of very bad fiscal situations.

This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?
Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.
Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.

I am into Datawarehousing and BI. Worked in multiple technology such as Oracle BI, Cognos, Informatica. It is frustrating to see my mid-size American Consulting Company charging the client a $180 per hour while I get $85K per annum. I cannot even switch to my client since I have signed a non-compete agreement..... I think direct marketing is the best way to augment your rates....
Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? Stoppers idea is brilliant and should be done on a big scale. It will convey a strong message and will be in news.
These are my predictions if we do this stopper thing
1) People will try to know what this whole thing is about. ( So we should have the stage set for the propaganda to tell americans that they will lose big if we go home)
2) This could have a negative impact of drawing more anti-immigrant crowd which want us to leave no matter what. ( For a common american jobs for his himself and family is more important than what we are trying to say)
3) Stopper companies would get some free publicity ( Maybe some company is out there to sponsor this)

My PD has been current quite a few times since 06/2007. Last time when I called TSC, my NC was still pending. My FP was done during 07/07 and I heard from some one in this thread that FP is valid for 15 months only. So what should I do now. Should I go for an infopass and take an FP appointment ? Guys please advise.
It appears that you are EB2-ROW. With that old PD, you should definitely take an Infopass and ask what is holding up. As per regulations they are not supposed to wait for NC for more than 180 days, unless something suggesting "name not cleared" has been provided by FBI

Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.
Yup...according to my lawyer, hard copy is required. I had all my paperwork in by the 22nd..and the reason they did not file on Friday for Monday delivery was that there was no Labor copy. Luckily the labor arrived on Friday...but then my case got pushed behind others...

It is actually meaningless unless they make it public - say - send a letter saying that your case is preadjudicated and all we are doing here is waiting for the number.
If it is something internal - then well as long as your file is lying on the shelf waiting for visa availability internal policies may change anytime.
The entire preadjudication thing was started at the peak of economic turmoil - some say it was planned to weed out as many bad apples as possible from the GC queue by issuing denials, noids and rfes - if this is the case - then this will continue to happen as long as economy does not improve and job market is still bad.

According to my lawyer, the person (in this case your wife) must be in USA until your wife's AP application is accepted. Basically your wife should not try to apply AP when the she is not physically in USA.
After the application acceptance, your wife can travel.
Disclaimer: Please do not take this granted and always consult your immigration attorney.
I would like to differ on this, the person applying for a renewal of AP does not have to be physically present in the US until the AP is approved. Our attorney confirmed this and if you notice on the AP application form it states if the document has to be mailed to a different address other than USA.
Our attorney said one can apply for a renewal even from a different country, the clause that one has to be physically present in US is only for the initial I485 and AP application.
I have applied for AP renewal on June 23rd and am traveling next month to India for 2 months will be back before my current AP expires i.e. Oct 10th. My attorney actually asked me to apply for renewal before I leave for India.

There has been established a way to deal with backlogs at Dallas and Philly, and these officials at PBEC and DBEC have been given a deadline of Sept 2007 to clear everything. So someting is and will be done in this regard. Not much more can be done here with PBEC or DBEC, and the real test is to get solutions for the retrogression.
Once the laws are passed on the immigration reforms, its a done deal my friend, and then it does not matter how much we try after this to address retrogression. This is our only chance.
BUT realize that there have been delays in PBEC and DBEC only because of lack of resources, which can be added or taken off...and this will speed up or slow down DBEC or PBEC. This can be controlled outside legislation.

i am in the 3.a. situation. what does part time mean? can you really be working part time when you are a CEO, CFO, COO, CMO of a company? not that i am raising this questions... I want to continue to be in the 3.a. situation, but can the IO ask these questions? if i make revenue of $20000 (twenty thou) and profit of $2000 a year will that be considered enough for IO to think that my intention is to switch to my company after green card and hence no intention of continuing permanent employment? or is that number higher (or lower)...

IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).
This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.
Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.
Bottomline, do not underestimate America. They know what they do.
I share your thoughts. There are a multitude of sectors/issues that are mimicking the American style. With the advent of ICICI, any body can pretty much walk in and get a loan with a 30 yr EMI. Imagine the number of people losing jobs in India, both at Multinational and local companies providing services if the economy tanks here. What are people gonna do with home loans they signed up for 30 yrs or what ever? Fore closures on a grand scale?? Indian economy has been going up.. up and up due to software services and BPO sector. With out any manufacturing, infrastructure building up it would be very difficult for Indian economy to sustain growth or level out gracefully when hit hard. IMHO, Just being the back office of the world will not get India on par with US.
This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.
Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.
Bottomline, do not underestimate America. They know what they do.
I share your thoughts. There are a multitude of sectors/issues that are mimicking the American style. With the advent of ICICI, any body can pretty much walk in and get a loan with a 30 yr EMI. Imagine the number of people losing jobs in India, both at Multinational and local companies providing services if the economy tanks here. My current EAD expires this Friday. I e-filed on May 5th. Infopass after 90 days did not help. They approved my expedite request on 19th and said I should hear something in 14 days which is another 5-6 days.
I did contact my Senator (Cornyn) who actually offers to help with time-sensitive problems with federal agencies. This was about 2 weeks ago, even before I submitted my expedite request. I'm going to give them a call tomorrow to see if they have heard anything.

Senator Dianne Feinstein (D- CA)
Senator Barbara Boxer (D- CA)
I think the senators which you mentioned are from CALIFORNIA STATE SENATE (State Government).
