I just read somewhere...that if I do not file by I140 by July 31 the i lose chance to file I485 by august 17..which i could file anyway together if I have to file it by July31..Is this true..

the reason being that I am waiting for the hard copy of Labor Approval and the only thing I have is Cover letter copy..I do not want to miss chance

    My PD is Oct 2001

    Please please let me know!!

    DB

I think its only for labor exempt cases. Since your PD is 2001...u r fine to file by aug17th
Some people here say LC must be cleared by July 31st...so u r fine that way too. Your LC will say a approval date in July...so u r ok...(eventhough some argue that its not important)

I believe the senate majority and minority leader do have the right to call for debates on a previously declared holiday. Thats excactly what happened during the debate for S.1932. It went late into the night until 1.00 am and then restarted next day on a holday!

Can we make use of this town hall meeting? Any Idea?

    http://www.aila.org/content/default.aspx?docid=20340

Town Hall meetings are an excellent chance for you to show your Members of Congress that positive immigration legislation is a priority for their constituents. Check this calendar so you don't miss these opportunities to ask your legislators for their positions on immigration, and tell them yours!

Your priority date is not yet current. It will be in August.

Also you need to prove that you have exhausted all ways to get it adjudicated.

    InfoPass - Eitherway its useless
    Approaching your senator.

If none of these work then you apply for WOM
Otherwise your case will be weak and be thrown out

    HI Gurus,

I need advice from you guys,

My priority date is June 2005 (EB2) and my I-485 receipt date is July 7th 2007 at TSC

My questions regarding Writ of Mandamus are
    1. Would I be qualified to file for Writ of Mandamus (WOM)?
    2. If I am qualified, would it be of any benefit for me to file WOM based on my criteria as
    detailed above?

    Thanks a lot.

    Send copies of ALL I-94s.

Do NOT travel with expired/non-renewed documents.

    It's simple!

    hi guys,

i have a 485 filing question. i'm on EB2, ready to file for 485. however, i am in india on a family matter and will have to return only for the filing. i know it is "sooner the better", but i am trying to figure out how late i can return to US.

i have read on this forum that dates will retrogress in august. any informed people out there know how likely that is?

also, if i have to make it there in july to file 485, any idea about how long after filing i need to stay in the US before i can return back to india? i mean, any rules which say you cannot travel before such-and-such happens?

thanks in advance, and sorry if the above are dumb questions.
No one can tell you what will happen next month or 2 months from now.The best day to file 485 is July 2nd.

Once USICS receives your app they will send out a document for finger printing. You should take a infopass appt and go to a local USCIS office to be finger printed.
The time frame to receive this document ranges anywhere from a month to 2 or more.

    Hi Attorneys,

Recently I have filed my H1B petition . However due to some emergency I need to quit my current organisation (Company A) who has sponsored the H1B . My questions are :

    1. Would there be any adverse effect if in future Company B files H1B for me ?
    2. What generally happens if I file H1B and am not able to attend the interview ?
    3. Is there any way Company A can revoke the H1B petition after I resign before H1B interview ?

    Would appreciate a quick a reply .

    1. There shouldn't be any negative consequences if you change from one H-1B employer to another. People do this all the time.

    2. What "interview" do you refer to? If you mean a visa interview at the consulate, you should cancel if you cannot attend.

    3. Company A can and should withdraw the H-1B petition once you leave the company. This should not affect you getting new H-1B status, assuming there is no major gap between leaving Company A and Company B filing the new petition.

    IV,

Please start a webfax campaign in support of the Amendment S.1249, being co-sponsored by senators Maria Cantwell (D-Wash), John Cornyn (R-Tex.), Patrick Leahy (D-Vt.), Orrin Hatch (R-Pa.), and Robert Bennett (R-Utah).

There is no use just opposing the existing bill without proposing what we want actually.

I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question

    I'm applying for:
    a) Permission to accept employment
    b) Replacement
    c) Renewal of my permission to accept employment

I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response

    Please advise.....

    Thanks

The option "a" will be used, for "c" you need previous EAD. Refer to http://immigrationvoice.org/forum/showthread.php?t=18737, which addresses several issues.

You can stay here as long as the I797 is valid (there is no rule to stamp it within a year). Do you have H1B stamped frome before or is this your first H1? If the first one then you have to get it stamped when you travel out of US. If this is not the first one then you can travel back on your old H1 stamp with new I797.

it is around $27 and I got both H1 and EAD.

    It is a huge difference.

Are you getting like $150/hr rate?

    What do you do?

An investment of $500,000 may be sufficient if the investment is in a rural area or in an area of high unemployment.

The best place to get all kind of information is:

Indian passport for minor children up to 15 years of age (http://www..com/nri/indianpassport/children-upto-15-years-of-age-minors.html)

I had recently applied for my 5 yr old son for passport renewal at washington DC embassy, as we fall under their jurisdiction and got the new passport.
I had mailed all the documents and it took around 1 months to get the passport.
Let me know for any more questions you have....

He can have both types of permanent residence pending at the same time - marriage-based and employment-based. This is very common. The marriage-based filing will probably be approved sooner than the other, because priority dates are so backlogged now.
That is wonderful news, Elaine, thanks so much for the fast reply! We are actually in the DFW area, so if we need a lawyer for this 2nd application, I'll remember your name!

My MTR was received by USCIS on June 25, 2009. Today I received an auto-generated email with case status update. My MTR has been denied :-(

Any advice for the next steps is appreciated.
