    Yesterday, I was told by the client that my project is going to end by this month end i.e Apr 30. Actually it was supposed to go for the next 2 years. I am currently in the project working for the project. They said the lay off was becoz of budget

    I think this is a very interesting topic. Neelima's story is about an American citizen of Indian origin. Since, she is an american she can choose to go to courts whereas we are non-immigrants with very few rights. If you are facing abuse at workplace the only solution for an H1B worker is to change jobs.

    That having been said, this highlights a very important aspect of the american society (or rather any culture) in general. You can become a US citizen but unless you are a european (read caucasian) immigrant you will become a hyphenated american. You can spend all your life in US and you will still be referred to as Indo-American/Asian-American at various points in your life. Some of it will be generic comments, some of it will be racist. Infact, you will always face more harassment from your fellow countrymen (e.g. desi consulting/desi manager) in US than from americans. An industrialist from Punjab visiting US gave me a fine example of this. He said, we employ 75% labor from UP/Bihar because they are cheaper and subservient. We make one of them the foreman and he's the one responsible for getting the work done. The same thing happens in US, the first line managers are Indians and so are the tech employees. [Off course, some of the Indians have risen to great positions on the corporate ladder and that is a testimony to both their abiliity and the general open-mindedness of american people.]

    The choice is yours. Do you want to enjoy the wealth of this great country and tolerate occassional racism or do you want to be in your own land and be not as well off?

    On a lighter note, as far as curry smell is concerned, I have heard goray complain about curries, Indians complain about how chinese ppl stink up the kitchen when they heat food. None of the smells are offensive, ppl just aren't used to those smells.

    Pappu no need to ask People to do something. We all, includiing me want others to do the work and we just want to make annonymous remarks blaming IV. We must admit that we really like doing this. :) The original poster Endlesswait came to the site and blamed IV for not doing anything and went away without doing anything. This dude AlbertPinto is just saying many times that IV is not doing anything but is not doing anything himself. You have asked him to do somehing, let us see if he really does something.

    Like others, I will also not do anything and will be here to give my 2 cents. This is the easiest task we can all do. Isn't it?

    if we go to canada to get H4 stamping will they ask for her pay stubs or just my pay stubs are enough.
    H4 is a dependent visa and there is NO legal employment allowed on H4 status.
    Is there any chance of rejection. also can I go to canada for stamping or do i have to go to home country.
    if wife's stay in US has been legal and she has been in status then there should be no worries. For H4 make sure you carry all the H1 documents as well.
    is there any site or posting that explains the process of applying for H4 in canada.
    check websites for US consulate in canada where you want to go for stamping. They will list all documents required.

    It's inevitable with so much unemployment there will be a rise in crime. Best thing to do is to install car security alarms, be wary of strangers and stay away from shady places.     Yes, perhaps people don't post these type of investigations. If you have heard any N-400 issues (from your corporate position) about someone caused by leaving the petitioning employer soon after GC then let us know, otherwise it is one of the rarest of rare issues. My attorney clearly mentioned to me that he has seen no such issues in his long career when someone left the employer soon after.

    Coming back to the AC21...if someone changes to a similar job after 180+ days after filing I-485 and informs USCIS of it and then gets a GC, there is no question of any wrongdoing. If USCIS wants to do their audit investigations I wouldn't care an iota about their investigations as long as I have the right paperwork with me.

    Secondly in a non-AC21 case even if one leaves the job of the petitioning company immedaitely how does the intent become questionable when the person is working for the same company for several (5+) years. On the contrary it would be easy to prove the intent here.


    I'm just curious as to how many postings you see on these boards where a persons case has been denied; DOL/USCIS has visited their home; their visa got cancelled by consultate when h-4 went for stamping; got caught in interview lying; DOL investigating companies, etc...

    People do not post these types of issues on immigration forums.

    Getting expungemen t wouldnot help in his case.
    For immigration purposes, his conviction stands.
    Everytime when he visits consulate for a visa or enters USA at POE, he needs to indicate this on documents and provide explanation (if asked ) with relevant documents.

    Yes, I do agree with you but he asked a specific question related to travelling, and his expungement will help. He need not to declare at the POE about his case but as you said he will have the side effects of this case in various other stages till he is admitted as PR.

    Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

    This is one of the biggest bottleneck to 485 and naturalization processing. Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.

    This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?

    Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.

    Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.

    85 % of the fortune 500 CEOs are not MBAs. And the other 15% that have an MBA, only 3 of the 15 have done MBA from an IVY LEAGUE school.

    What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.

    The biggest prize goes NOT TO people who can follow directions and know everything, but who can GIVE directions and get things done.

    That a decent logic. Why do we have olympics and celebrate the winner of 100m dash? Don't we have cars/trains/planes that can go faster than 100m in 9.2 sec. Then why race to find out who runs faster than others. Its the same reason for Spelling Bee, I guess.

    No you don't. You can file without 140 receipt, atleast that's what my lawyer told me. Anyways, mine is concurrent filing.

    IT TAKES A VILLAGE -- Chain Migration Puts Nearly Everybody In Line To Overwhelm U.S. Communities

    As soon as we take a single skilled immigrant from a developing nation, around 17 different families may be put in line to follow because of our reckless Chain Migration policies.

    Our immigration policies literally "take a village" every time a new Anchor Immigrant is admitted to this country.

    Fortunately, our immigration policies do have a few boundaries and delays that keep the whole village from entering our U.S. communities immediately. But every one of the members of those 17 families begins to consider future immigration to the U.S. as an entitlement. And because of that, millions don't wait for their turn, instead settling in the U.S. illegally to wait for the greencard that they believe is rightfully theirs.

    THE 'ANCHOR IMMIGRANT'
    Our U.S. population is exploding -- consigning more and more of us to heavily congested, heavily regulated lives -- because of high immigration numbers, which have snowballed because Congress insists on continuing Chain Migration.

    Because of Chain Migration, every immigrant we allow into the country because he/she brings a special skill, education or experience becomes an Anchor Immigrant.

    That is, if officials determine that an employer can't find an American to fill a job and allow the importation of a foreign worker, that worker becomes an anchor in the U.S. for vast numbers of other people from his/her home country.

    One problem for the United States is that only the Anchor Immigrant is supposed to be picked on the basis of serving the national interest.

    All the other immigrants attached to that Anchor through Chain Migration get to come without any regard whatsoever to their education, skill or humanitarian need.

    ONE ANCHOR CONNECTS TO 17 FAMILIES
    My "17-Family Chain-Migration Village" example is not close to the worst possible scenario but it is a nightmare that is not uncommon.

    Here's the scenario:

    Consider a typical Anchor Immigrant who comes from a developing nation and has three adult siblings. All of them come from one family. As soon as the Anchor Immigrant is accepted, all those siblings know that the Anchor Immigrant can put them in line for immigration once he/she becomes a U.S. citizen. Mentally, that one whole family is now in line to come to America.
    But there are many more families who mentally get in line, too. The Anchor's spouse, plus each of those three siblings' spouses will be eligible. That makes five families now in line (the original plus the families of the four spouses).
    In every one of those families are their own siblings, minor children, parents, etc. This is getting to be quite a crowd of people who suddenly see their future as possibly being in the U.S. That makes five families involved now (the original and the four spouses' families).
    Now, consider the siblings of those four spouses. That would be 3 siblings multiplied by the 4 spouses, equalling 12 more adults, all of whom potentially have their own spouses! Potentially, each of those 12 spouses of the siblings of the spouses of the Anchor's siblings is from a different family.
    Now, you have those 12 families, plus the Anchor's family, plus the families of the four spouses of the three siblings of the Anchor. That potentially adds up to 17 families that immediately can know that they are in a chain that eventually can have a chance to immigrate to America. And all of that happens the minute our government decides to give a permanent work permit to a single foreign worker.
    An Anchor Immigrant immediately creates chains of expectation into possibly 17 different families.

    You can imagine how a village or urban neighborhood can quickly have most of its residents seeing that their future is in the United States. Not only does this build huge pressures for more migration and more population growth in the U.S. but it saps whole villages and neighborhoods of the will for self-improvement.

    Why will people pour themselves into bettering their own communities when they believe their future lies living in America? And, of course, the chain migration does not end with those 17 families. Our rules are set up so that every Chain Immigrant also becomes an Anchor Immigrant, making it possible for every relative to get in line to come to the U.S.

    The only solution is to end the Chain Migration categories entirely. (See our pages on the legislative solutions.) That means limiting each Anchor Immigrant to bringing a spouse and minor children. No adult children, siblings or parents.

    The Anchor Immigrant can easily visit his/her relatives annually (or more often) and can be in constant communication by phone, internet and postal mail. Chain categories must be ended if we are to avoid the nightmare of 439 million U.S. population in 2050 as projected by the Census Bureau.

    CONGRESS THREATENING TO ADD 550,000 MORE 'ANCHOR IMMIGRANTS' NEXT YEAR

    Sen. Menendez of New Jersey is blocking the re-authorization of E-Verify (to keep illegal aliens out of jobs) until Congress agrees to add 550,000 additional Anchor Immigrants next year.

    At the moment, the leadership of both Senate and House are seriously considering trying to pass the 550,000 increase in Anchor Immigrants.

    Powerful media like the Los Angeles Times and New York Times are lobbying hard for more Anchor Immigrants.

    Unless the American people themselves become fully aware of the dangers of Chain Migration and the concept of the "17-Family Chain-Migration Village," the Big Business and Big Media lobbyists are likely to multiply the chain migration nightmare many times again.

    Make sure you have gone to your NumbersUSA Action Buffet and sent all your free faxes to push your Members of Congress to stop Sen. Menendez and to eliminate Chain Migration.

    Now that Democrats have taken the house and will soon bid adieu to rabidly anti-immigration Republicans in key posts like Sesenbrenner and Hastert, it does bring in a new ray of hope for us.

    What this means for us in two houses:

    Senate:

    - To get anything done in the Senate, a bill needs support of more than 60 votes.

    - Even if Democrats control Senate, which we will find out after a Virginia recount, they will really have to work in a bi-partisan manner. If we look at past trend the Senate was open to immigration reform.

    Lower House:

    - Due to "majority of the majority" rule by soon to be former house speaker Hastert, NO non-conservative agenda saw the light of the day in last congress.

    -This effectively turned into a do-nothing congress.

    - New Democrat speaker Nancy Pelosi brings hope for millions.

    - This is a good chance for Bush to show what he can rally around all Americans not just the conservatives.

    This election has shown that the American democratic system does work and that there is still hope for immigration reforms.


    Maybe, this is too early to celebrate but I will go out and have an ice-cream :o some good news after a long draught

    IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).

    This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.

    Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.

    Bottomline, do not underestimate America. They know what they do.

    You are right they know what they do but it will be beneficial for US economy only. In terms to USD to INR, we will lose. Check the history and present.
    In case of Japan, Yen was fixed to 360 Y to 1 $ in 1949.

This undervaluation was reflected in the current account balance, which had risen from the deficits of the early 1960s to a then-large surplus of U.S. $5.8 billion in 1971. The belief that the yen, and several other major currencies, were undervalued motivated the United States' actions in 1971.�

    �Following the United States' measures to devalue the dollar in the summer of 1971, the Japanese government agreed to a new, fixed exchange rate as part of the Smithsonian Agreement, signed at the end of the year. This agreement set the exchange rate at �308 per US$1.�

    �In 1985 a dramatic change began. Finance officials from major nations signed an agreement (the Plaza Accord) affirming that the dollar was overvalued (and, therefore, the yen undervalued). This agreement, and shifting supply and demand pressures in the markets, led to a rapid rise in the value of the yen. From its average of �239 per US$1 in 1985, the yen rose to a peak of �128 in 1988, virtually doubling its value relative to the dollar. After declining somewhat in 1989 and 1990, it reached a new high of �123 to US$1 in December 1992. In April 1995, the yen hit a peak of under 80 yen per dollar, temporarily making Japan's economy nearly the size of the US.�

    This way both US and Japan economies are stabilized now but Yen value became high from 360 to 115 per dollar now.

    It is happening with China also. Us is pressing China to raise the value of Yuan and devalue dollar against Yuan so US exports can be cheaper in China and Chinese exports can be expensive in US.

    Future is India. After too much of outsourcing, INR will raise again USD and my guestimate is 1 USD to 20 INR after 10 years.

    Time to convert all savings in INR.
