    As per the state dept folks, pretty much all categories are using all their allocated numbers. So where is the spill over going to come from?
    country quota will not impact I and C once the dates are current for ROW due to the spillover. If the number of applications pending is, say 100K and 95 K out of that are I and C. And assume 10K applications from ROW are add to the queue, what I am saying is all 110K will be cleared by end of the fiscal year.

    Send email to who ? Can you pls describe in detail what email they need to send and what reason they need to put in. My local office always says NSC is processing July cases so you should have it soon, but that "soon" has never happened. It is 160+ days since I applied.

    The only reason you need is that yor EAD app is pending more than 90 days. Ask for a receipt that they followed procedures outlined in memo. They have to contact service center where your I-765 is pending and request expedite processing. You can also print federal regulations

    Section 274a.13(d) sets that 90 days deadline.

    Hi All,

    FYI for you'll. I e-filed mine and wife's on June 6 at NSC lockbox in Phoenix. Opened a SR for both on Sept 7. Got approval emails for both of them Friday Sept 24. Also gotten soft LUD's on both applications a couple of days before the approval emails. If anybody needs more information, please let me know.

    My daughter has received her new US passport. Her Indian visa is in her old passport. I understand she can carry both passports with her to India and does not need a new visa. Am I right? Thanks.


    You can also get new passport number added to PIO card. So that you need not carry two passports.

    desi3933 is right.

    - While on a H1 or a L1 visa, one is expected to maintain a continous period of employment. If one is on a H1 visa and does not get paid, that individual automatically falls "out of status".
    - It does not matter if the person has other seemingly valid visa stamps on his/her passport.
    - The only highly-skilled dual intent visas that allow one to work, are the H1 and the L1, as far as I am aware of. Dependent visas do not allow one to work, such as H4 or L2. The only way one can work while being a dependent is if one has an EAD based on a pending AOS(I-485).
    - If one is on a H1/L1 and wants to switch to say a dependent visa (H4 or L2), one has to submit a change of status form (I-539?). The person is assumed to be in "authorized status" until the change of status (or even an extension) occurs. If the COS or extension gets denied, the person is retroactively "out of status" from the original date of expiration on the previous visa.
    This is correct ONLY if person is maintaining status at the time of application. If the person is out of status then filing change of status petition does not put him/her in status.

    - Accruing over 180 days will entail a bar of 3 years for re-entry after the person leaves the US.
    - Accruing over 365 days will entail a bar of 10 years for re-entry after the person leaves the US.
    3/10 year ban applies to unlawful presence only and NOT for out of status. If I-94 date is passed, only then person starts accumulating unlawful presence. There is a BIG distinction between unlawful presence and out of status.

    Under the current system, unfortunately, there is limited employee protection or even whistle-blowing, so seek a competent attorney's advice right away.

    - Remember, the affected individual(in this case your wife) has a lot to lose if she leaves the US(ie cross the official border), even to visit Canada. Competent attorneys can help arrange for waivers from typically the home consulate(ie consulate in home country). Consulates in third countries do not entertain applicants for visa stamping or visa renewals if they have not maintained status

    This is an issue ONLY if I-94 date is passed. Out of Status is not an issue for visa stamping (The key thing here is I-94 date).

    - If the home consulate approves the said individual's visa renewal or new visa stamping, that individual can enter the US, however, there is lack of clarity on whether such a person will be finally able to "adjust status" to become a lawful permanent resident.

    This is a SERIOUS matter requiring legal competent advice.

    See my comments in Blue above. There is a BIG distinction between unlawful presence and out of status.

    The best way to get back into status is to re-enter in USA with the proper visa (h4/l2) visa stamp.

    The I-485 can be denied if the person is out of status > 180 days (since last entry in USA) at the time of filing.

    Paying employer for generating "pay stubs" can land one in deep trouble. PLEASE consult a good attorney before paying for pay stubs.

    There are actions "missed" by Employers. But, that is beyond the scope of current discussion.

    I will be writing a detailed note on how to handle out of status issues.

    Remember, 245i cases were the NOT the same as the mexican illegal aliens that are being spoken of in relation to CIR .. lots of educated, legal H1-Bs lost their jobs (and their legal status) during the dot com burst of 2000 - 2002. Some of them stayed on even after going out of status, and then became eligible to file for GC under 245i.And needless to say, many more of those H1s came from India than mexico.

    These people are illegal nevertheless, and I am ashamed that they are from my country.

    Yes, I called them and they said the process would generally take 30-40 days. They said, keep checking if your checks have cashed... I read in 1 message board some one posted that checks are cashed on Thursday............so tomorrow is a Thursday :D

    Any body called NSC reg. the fate of July 2 filers !!!!

    From what I remember, when we wrote to President Bush, only 5000 letters were sent.
    I dont think a number like 50,000 could ever be reached.

    That's why we couldn't solve all the admin related issues then. If we had significant volume, we could have had visa re-stamping done in USA and the list goes on.. Any ways, I don't mean to give numbers.. But as long as we are on the same page that volume speaks and we don't have enough at this point of time, I am good.

    We need a mass movement to make an impact. They need to get frustrated with the letters and will have to give a press statement that they are reviewing the matter. As long as we can do that. I think we can get DOJ attention. If 5K members send letters 10 times in 2 months, I have no issue, as long as we can annoy them with letters for justice..

    I have watched it a couple of time, though not a regular. No chance of getting there unless you are celeb fresh out of rehab and/or facing midlife crisis, divorce etc., or a US political bigwig.

    We are none of the above.

    Looks like we need to catch hold �Larry King�. If we can project our Green Card issue through 'Larry King', then it would easily catch US National attention.

    Can some one throw ideas on this please?.

    Yes the initial reason for denial is bogus, but they may still deny it because of "too restrictive requirements"

    What do you mean by "too restrictive requirements"?? so do you think I will be better off finding another job with a different company so I can apply for a new PERM (EB2) or just wait for the appeal that is now over 6 months??

    Also, I know that the reviewing officer is supposed to review my appeal request and send a copy to the appeal board so they can make a decision but he/she has not done that because I convinced the HR in my company to call the board of appeal and they said they haven't received my appeal request from the reviewing officer ( he was supposed to send it within 30 days). he has had my appeal request for over 6 months. I am not sure what to do at this stage. I feel like I am stuck.[/QUOTE]
    This is how they sabotage it! By the rule you must send the appeal to the same office that denied your PERM. Then they must send the appeal file to BALCA (and a copy to the employer IMMEDIATELY), but they pretend they never received it from you, I guess. They violate the law, but I don't know if we can do anything. Assembly the appeal file yourself and write to BALCA that you did file the appeal with the center (you have a proof that the mail has delivered it, right?) but it was them who, in violation of the law, haven't forwarded it to BALCA yet. 6 months can not be considered IMMEDIATE under any circumstances.

    Nothing. Even you loose $20 bill everymonth, it won't be a big deal or even if you get it everymonth by way of incentive, not a big deal. :p

    One of my friend told me that he got his labour certification approved yesterday, I said "Welcome to the world of frustation" where there is no entry fee but an exit fee is $20 a month.

    I think if all of us (Existing contributors) could succeed in getting one more contributor then we would be double in number very soon.

    Hello,

    I have a similar situation, but different factors. My labor has been approved May 2007 and I can apply for my 140 and 485 together and I'll do it now well before Aug 16. I'm getting married and my wife would be here by September or October. She'll be on H4. I won't be applying for my EAD if she decides to be on H4. If the dates go back to say 2005, I will need to wait for my priority date of May 2007 to come CURRENT again and then only do her AOS (I'm assuming until then even my 485 won't be touched by USCIS). Once my date becomes current and my application starts processing, I'll add her immediately.

    Now the only thing I'd be missing in such a case would be applying for my EAD anytime soon. If she decides to apply for H1B next year or even go on
    F1, then I can apply my EAD and start using it. I'll be on my EAD and she'll be on H1/F1. When my priority date becomes current (in a few years assuming), then I can add her AOS.

    Please suggest what should I do now ??

    Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. What r IRS forms?. Finally any good attorney suggestions for Houston, TX.

    What are the options for business formation,

    Does anyone see any issue with this kind of formation and GC process for me.

    I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.

    I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.

    I think this is a wrong forum . you might want to get in touch with NRA (most of the members of NRA are very conservative ) .... They might help you or make you a plaintiff in a lawsuit.. Supreme court may very well favor you given their recent second amendment rulings :)

    Until this point of time, no one knows how USCIS or state is calculating the figures. So, lets wait and see the lottery results. Thats the only way to get the green card faster :)

    The following are various ways to express some one�s dissatisfaction/agony and draw some one else (Government/Media/Public) attention.

    1. Daily Fasting : One or more people would sit for fasting from 6 AM to 6 PM. One group would pass on the fire to next group.
    2. Continuous Fasting : One or more people would sit for fasting 24 hours a day. Such people should not have health issues like Blood Pressure, Gastric Trouble, Sugar, insulin deficiency, Heart relates issues. This may cuase arrest.
    3. Protesting : Conduct a rally with group/mass of people with immigration ply cards and banners.
    4. Wearing Black Ribbons : People would wear/put a small black ribbon on their shirt pockets (Upper left side of the chest) and attend duties. We can draw people attentions. Such ribbon should have white color immigration slogan printed on it.
    5. Distributing Flyers : Distributing Flyers/Handouts to people in respective areas.
    6. Banners : Display banner/show outs in the Traffic Island Medians
    7. Flower Campaign : Sending Flowers to respective people, also called Gandhi giri.
    8. Silent Sitting : Sitting in front of USCIS silently (no talk).
    9. Silent sitting in front of Senators house: Group of people should sit (kind of protest) in front of respective state senators. We can draw maximum MEDIA attention.
    10. Sweeping Roads : A group of people would sweep roads by wearing immigration slogans jackets.
    11. Organize Blood Donate Drives : Interested member would donate blood (We should explain to media, why we are doing so).
    12. Rally in All Major Cities : Conduct a rally in all Major cities (where we have at least 100 members) at the same time.


    We still have various other ways to express our dissatisfaction, however, they are little rude and could cause more issues.

    We should choose couple of ways from above to express our dissatisfaction. Members, feel free to add and delete from above list.

    P.S: We need prior permission from local authorities

    Looks like we have to some thing big at this Christmas season.
