Hi All,

Please help me with this. i came to USA on L1B visa in 2005 with 1 year petition and got extension for 2 more years i.e till feb 2008 but went to india for good in June 2007.
Again we came back with new L1B petition in Oct 2007 and got 3 years visa i.e, till Oct 2010.

1) Now if company apply for extension on L1B how many years ext i'll get?
2) Now if Company B wants to file new H1B for me, how many years of visa i'll get.

i was never on H1 before this is my first time H1B.
Please help me with this as soon as possible.

Friends,

I came to USA on H1B on Feb-07. I was working all the time except 6 months. I have pay slips with me and W2 forms. Now I am working on the project but it will be over on 15th of April-09.

I will complete my 3 years. But after this project is over, I don't know I can find the job again.

My question is,is it right time to do the visa transfer? Does it requires very recent pay stub of 3 months? I do not have pay stub for Jan and Feb-09.Does it matters?

What will be my best choice to transfer the visa(but don't know will have job after 15th so does it matters for transfer like client letter) or wait until May-June and file the 3 year extension ? But again that time I will have pay slips until April only.

I am really confused. Please give me your suggestions

Hi, I have been noticing on .com that even after the mess-ups in Aug 08 when similar visa bulletin came out and uscis approved lots of cases from 06 ignoring people from 04 and 05, they are not approving cases in pd order even now (well not like before but still bad). I mean how can they approve sep 05 cases before all 03/2005 cases are approved especially if they are all pre-adj and ready (atleast most are). Even though technically anyone until oct 1, 2005 is eligible for visa number, Shouldn't they go in order? This is very unfair given you don't know when they might run out of numbers and TSC is snail paced doing 3-6 approvals a day atmost while NSC is doing tons a day :) Any comments?

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.

I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

I have two I - 140s pending (say A and B)

I am applying I-485 for A (140)

If my I-140 for A gets denied can I change the I-485 to use I 140 from B later?

Or do I need to apply for I-485 freshly with I-140 from B?

I got my labor approved in Jan (EB2 - RIR) , I say EB2 because because all the documentation was done supporting EB2 (BS + 5 years). My job requires that and I meet the criteria.

However, when Applying my I140 , the lawyer screwed up and filed under EB3 and got approved.


I very much want to go for EB2. Is it possible to file I140 again under EB2 with the same LC? If I want to re-file, do I have to or do they (USICS) cancel my previous I140 approval ?

Is filing another LC under PERM and I140 safer route than using the current LC ?

What is the best course of action ?

I know there is a clear advantage today in being in EB2 over EB3 (PD wise) and it looks like most people are converting from EB3 to EB2. I am not sure whether there will be any advantage of being in EB2 over EB3 by the time my PD (oct 04) becomes current.

Any input is appreciated. Thanks in advance guys.

Other than name check are there any other stuff we should be aware of to get the green card.

With this new 180 day rule can I get my GC even if my Namecheck is not complete in 180 days. Is so once my PD is current and my 485 application has crossed the processing times can i go ahead and demand (please note demand) my green card or should i just leave it to luck and keep waiting hoping i will get it soon. sorry for sounding so sorrowful but the process seems to be very happazard.

Hi, I have a H1B from company A stamped in my passport and it has been expired in sep 2005. I joined company B in march 2004 and I have their I-797 valis till Jan 2008. I am going to India to stamp it on the passport. Is their any issue with this ? I heard that if one is changing the comany, he/she has to stamp the H1B of the new company on the passport within 6 months or so. Please help.

-One highly-skilled professional's package, hand-delivered by employer's attorney on July 2, monday morning to USCIS (NSC) was apparently not accepted
- One would expect that they open the package and send it back with a letter stating a reason for refusal
- What evidence can an applicant present in such a situation that his package was attempted to be delivered? (no fedex tracking number or other such reference).
